Please read these Terms of Service (“Terms”) carefully before using the Ergzo mobile application, website, and related services (collectively, the “Service”), operated by Ergzo Solutions Private Limited (“Ergzo”, “we”, “our”, or “us”). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy.
By creating an account, receiving organization-provisioned access, joining a demo account, or using any part of the Service, you confirm that you are at least 18 years old and have authority to act for the organization or team using the Service. If you do not agree to these Terms, you must not use the Service.
Ergzo is a workplace ergonomic assessment and reporting platform that helps authorized users evaluate musculoskeletal risks using validated methods and workflow tools. The Service may include camera-based assessment, gallery import, optional local screen recording, dashboards, intervention tracking, reporting, and optional AI-generated recommendations and action plans.
The Service is intended for qualified safety professionals, ergonomists, EHS teams, HR and operations personnel, and other authorized workplace users. The Service is not designed for general consumer use.
Ergzo is a professional workplace screening and risk-analysis tool. It is not a medical device and does not provide medical diagnosis, treatment, or clinical advice. Assessment outputs are intended to support ergonomic and safety decision-making by trained personnel, not to replace professional judgment.
Access may be provisioned externally by the customer organization, and account creation or sign-up options may be limited, disabled, or restricted to demonstration use depending on the deployment. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
Depending on your workflow, assessment data may include posture keypoints, joint angles, scores, risk levels, timestamps, department data, task context, scene context, and related analytics. Raw photos, videos, and optional screen-recorded replays are intended to be processed locally on the device unless the user explicitly exports or shares them outside the app.
By using the Service, you grant Ergzo a limited, non-exclusive, revocable licence to process assessment data solely as needed to provide, secure, maintain, improve, and support the Service, and to perform the functions you or your organization request.
If the optional AI recommendations feature is used, you acknowledge that Ergzo may send limited non-media assessment data such as joint risks, scores, task context, and scene context to a third-party AI provider when a user explicitly requests that feature. You are responsible for reviewing AI outputs before relying on them in workplace decisions.
Important: AI-generated recommendations may be incomplete, inaccurate, or unsuitable for a specific workplace. They must be reviewed by a qualified person.
Ergzo may retain certain assessment and session records to preserve workplace safety history, audit integrity, intervention tracking, before-and-after comparison, and anti-underreporting controls. Some records may remain available even when other organizational data such as workers or departments are deleted or renamed.
Where allowed by the system design and applicable law, Ergzo may replace a worker name with a default or pseudonymous label rather than deleting assessment history where deletion would undermine safety records or workflow integrity.
All content, software, interfaces, branding, logos, and related materials in the Service are owned by Ergzo or its licensors and are protected by intellectual property laws. You may not copy, modify, reverse engineer, or distribute any part of the Service except as expressly permitted by law or authorized in writing by Ergzo.
The Service may depend on or integrate with third-party providers for authentication, cloud storage, communications, analytics, or AI features. Your use of those services may be subject to separate third-party terms and privacy policies. Ergzo is not responsible for third-party services outside its reasonable control.
We may suspend, restrict, or terminate your access to the Service if we reasonably believe you have violated these Terms, created a security risk, misused the Service, or acted in a way that is harmful to Ergzo, your organization, or any other person. We may also disable access in response to legal, security, or operational requirements.
The Service is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, Ergzo disclaims all warranties, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or that it will produce any specific business or safety outcome.
To the maximum extent permitted by law, Ergzo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, business interruption, or workplace decisions made based on assessment outputs. Nothing in these Terms limits liability to the extent such limitation is prohibited by applicable law.
You agree to indemnify and hold harmless Ergzo, its directors, officers, employees, contractors, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from your misuse of the Service, your violation of these Terms, your breach of applicable law, or your infringement of third-party rights.
These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts located in India, unless another forum is required by applicable law.
We may revise these Terms from time to time to reflect changes in the Service, legal requirements, or business operations. We will notify you of material changes by email, in-app notice, or another reasonable method. Continued use of the Service after the effective date of updated Terms constitutes acceptance of the revised Terms.
